Litigation, Legislation, Government
- Breaking: The US Supreme Court just ruled 9-0 in the Hemani case that being a regular user of marijuana is not enough to cost someone their gun rights. 18 U.S.C. § 922(g)(3) — the same law used to prosecute the Hunter Biden case — bans anyone who is an “unlawful user of ” or “addicted to” a “controlled substance” from buying, owning, or possessing a gun.Â
- The NRA, Michigan Coalition for Responsible Gun Owners, Michigan Gun Owners, Michigan Open Carry, and four NRA members have filed a lawsuit challenging Michigan’s firearm license-to-purchase and registration law, which generally requires individuals who do not possess a Michigan Concealed Pistol License to obtain a government-issued License to Purchase before they may purchase, possess, carry, or transport a pistol. The law further requires transaction records to be submitted to government authorities for entry into a statewide database maintained by the Michigan State Police.
- The Second Amendment Foundation has filed a federal lawsuit in California challenging Contra Costa County Sheriff’s Office policies that prohibit permit holders from carrying handguns equipped with red dot sights or flashlights, as well as their outright ban on the carry of single action only 1911- and 2011-style pistols.
- An alliance of firearms dealers and Second Amendment advocates have filed a federal Fourth Amendment lawsuit in US District Court against Colorado Gov. Jared Polis (D) over a law authorizing warrantless searches of gun sales records.
- The Colorado Supreme Court recognized on Monday that there is a right to self-defense in the workplace for which employers may not terminate workers so long as they lawfully exercise that right, saying “a private employer may not lawfully terminate an at-will employee for conduct related to the exercise of any inalienable constitutional right — even if the employee’s conduct plainly violates the employer’s policies.” Amen. This is the Circle K clerk case. I’m always surprised when Colorado does something sensible.
- Firearms Policy Coalition has filed an appeal to the US Fifth Circuit Court of Appeals in the case Ziegenfuss v. Martin, challenging Texas’s carry bans in numerous ordinary public places following the district court’s misguided opinion upholding the bans.
- Judge Matthew Kacsmaryk, writing for the US District Court for the Northern District of Texas, vacated and enjoined the ATF from enforcing the enhanced “Engaged in the Business” rule pushed through during the Biden Administration, which paved the way for universal background checks. The rule is overturned nationwide.
- A Florida appeals court ruled on Wednesday that Florida’s gun control law banning those aged 18-20 from legal concealed carry is unconstitutional. Duh.
- Maryland Court Rules Against Unconstitutional Stop-and-Frisk in Victory for State’s Gun Owners.
- The US Supreme Court declined to hear a challenge to a New York law that permits lawsuits against lawful gun makers, wholesalers and dealers for “endangering people’s safety through sales of firearms and ammunition.”
- And SCOTUS relisted 25 other gun cases.

The Only Ones
- The Pasadena Police Department in California finally released video footage of a September 7, 2025 incident in which one unidentified officer apparently shot another unidentified officer by mistake while engaging in horseplay with loaded firearms. No arrests reported.
- An unidentified Leon County, FL, deputy was caught on video drawing down on a motorist because he was holding… a gas pump nozzle at a gas station. That’s probably felony assault. No arrest reported.
- An unidentified Senatobia, MS, police officer fatally shot a 1-year-old baby in a car containing shoplifting suspects that was fleeing (or threatening, depending on whose story you believe) police. The mother may have been using the child as a shield.
- Kittitas County, WA, Sheriff’s Deputy Nick Burson was arrested at his home and fired from the sheriff’s office after allegedly pointing his gun at bar patrons early Sunday morning.
