Election Fallout
- After years of emasculating the US military through DEI initiatives, a new executive order under consideration by the Trump transition team would establish a “warrior board” of retired senior military personnel which would be granted the power to review three- and four-star officers and recommend any removals of those deemed unfit for leadership. Should this proposal come to pass, I suspect the board will be very busy.
Litigation
- Court Mistakes in Post-Bruen 2nd Amendment Cases. A Deep Dive.
- In a 6-0 decision, the Pennsylvania Supreme Court tossed Philadelphia’s lawsuit challenging the state’s firearm preemption laws, which prohibit local governments from passing gun laws stricter than the state’s laws, as unconstitutional. The Court ruled that Philadelphia’s legal theory for bringing the case did not withstand scrutiny.
- In a divided 4-3 decision, the Iowa Supreme Court ruled that the state may limit the gun rights of people who have been involuntarily committed over mental health concerns. The state’s highest court upheld a lower court decision against a man who was denied a concealed carry permit because he was involuntarily committed as a teenager. It ruled that the state’s gun rights restoration process does not violate the state’s recently adopted constitutional arms protection.
- Firearms Policy Coalition has filed a new federal lawsuit challenging New York’s ban on firearm carry by residents of other states. The case is Shaffer v. Quattrone.
- The Second Amendment Foundation has filed a federal lawsuit challenging restrictive gun control laws in Hawaii which discriminate against young adults, prohibiting them from acquiring, purchasing, and possessing firearms and ammunition, therefore violating their Second and Fourteenth Amendment rights.
- The newly formed New Jersey Firearm Owners Syndicate (NJFOS) has teamed up with the American Suppressor Association Foundation (ASA) and Silencer Shop in mounting a legal challenge to the state’s unconstitutional outright ban on firearm suppressors. They are looking for funding for the lawsuit.
