
Litigation
- The United States Court of Appeals for the Eleventh Circuit has erroneously ruled that machine guns are not protected by the Second Amendment, citing the late Supreme Court Justice Antonin Scalia’s faulty opinion in District of Columbia v. Heller. In Heller, the Court stated that weapons that are most useful in military service—M-16 rifles and the like—may be banned. But the Second Amendment was written specifically to protect weapons that are most useful for military purposes!
- A federal lawsuit (Solinsky v. Lopez) has resulted in a court-ordered permanent injunction against the State of Hawai’i. The case was brought under 42 U.S.C. § 1983 and the Second Amendment, challenging Hawai’i’s refusal to allow non-residents to obtain concealed carry permits. The injunction bars enforcement of HRS § 134-9(a)(5) to the extent it blocks non-residents from obtaining carry licenses based solely on residency.
- In a new order filed April 22, the District of Columbia Court of Appeals granted rehearing en banc in Benson v. United States/District of Columbia, vacated the panel’s March 5 opinion and judgment, and set the case for argument before the full court. The case is a challenge to Washington, D.C.’s ban on so-called “large-capacity magazines. The court has explicitly told the parties to brief not only the magazine ban, but also whether D.C.’s licensing and registration requirements themselves can survive Second Amendment scrutiny.
- The US Supreme court will hear Beaird v. United States, a Texas felon’s challenge to his sentence for possession of a gun. At issue are 18 U.S.C. § 922(g) and federal sentencing guidelines.

Legislation
- The anti-hunting and dog training language has been removed from the US House Farm Bill. The Greyhound Protection Act language, which would have impacted hunting with hounds and dog training practices, was eliminated following efforts by Congressional Sportsmen’s Foundation, Congressional Sportsmen’s Caucus, and Sportsmen’s Alliance.

Some say the case is “unusual” and very weak. But we already know that the SPLC is itself a corrupt hate group that has long been anti-conservative, anti-Christian, anti-gun, anti-2A, and anti-NRA.

The Only Ones
- US Army Lt. Col. Frank Ross Talbert pleaded guilty Monday to importing AK-style firearms parts from foreign countries, including Russia, without a license. As part of the plea deal, prosecutors will move to dismiss the remaining four charges against Talbert, which included firearms trafficking, transporting prohibited weapons without a license, dealing in firearms without a license and another charge of possessing an unregistered machine gun. But we note that none of the named parts are firearms, or necessary for a firearm to function, or illegal to buy or possess.
- A federal immigration agent accused of pointing his gun at occupants of a car after pulling alongside them on a Minneapolis-area highway is now wanted on felony assault charges in Minnesota.

- The new FN PUREVIEW is claimed to be the first holographic micro red dot pistol optic. Instead of the typical curved lens setup you see on most reflex sights, the PUREVIEW uses a flat pane of glass and projects the reticle using holographic-style technology. The result is a noticeably cleaner sight picture with less distortion, and it feels a lot closer to looking through a full-size holographic sight than a traditional pistol dot. The reticle is a 3 MOA dot, and FN says the system is truly parallax-free, with better light transmission thanks to that flat glass design. Even if the glass cracks, the reticle is designed to stay visible and hold zero. There’s a top-loading CR2032 battery, controls are tactile, with 14 brightness settings, including night vision modes and a few extra-bright options for harsh lighting. But battery life is only 800 hours of continuous use, with auto shutoff and standby mode that might extend life to 1 year. Black or Flat Dark Earth finish, red only reticle. Fits FN pistols and we don’t know what else. $749.
