- What if? What if laws passed by Congress were NOT presumed to be Constitutional? That would seem to make a lot more sense, given history.
- Ninth Circus reconsiders challenge to California restrictions on open carry of firearms, because the confused jurists are trying to figure out how to restrict citizens’ civil rights.
- The Ninth Circus has also held that suppressors are not “arms” protected by the plain text of the Second Amendment in United States v. DeBorba. Of course, the federal government still has no constitutional power to restrict most things that are arms or are not arms.
- The Brady Bunch (formerly known as Handgun Control Inc.) has sued the ATF over the agency’s new policy of declining to release documents about federally licensed dealers whose lawfully-sold firearms are later used by criminals in violent crimes.
- On June 3, the Firearms Policy Coalition, the California Gun Rights Foundation, and an individual FPC member filed Lopez v. Los Angeles in the US District Court for the Central District of California, challenging Los Angeles and Inglewood municipal ordinances that limit handgun purchases to one in any 30-day period. The lawsuit was filed because both cities continue to enforce local handgun rationing laws that are materially indistinguishable from California’s statewide version, which the Ninth Circuit already held unconstitutional.
- Florida: Gun purchase waiting periods unrelated to background checks are unconstitutional.
- SCOTUS declined to hear case on gun rights for non-violent felons after a lower court partially struck down the federal law banning them from owning guns.
- SCOTUS shirks protecting civil rights. Of course SCOTUS shirks the vast majority of its responsibility.

- SCOTUS Gun Watch 6/8/2026. The next conference is scheduled for June 18, at which the Justices plan to discuss a whopping 20 firearms law related cases.
- Virginia Fallout. Virginia residents are scrambling to purchase modern semiautomatic firearms before the state’s ban on so-called “assault weapons” takes effect on July 1. The law is in legal jeopardy due to litigation, but in the meantime sales have doubled and far exceed anything the industry considered possible.
- The US Department of Justice has opened a Second Amendment investigation to determine whether Philadelphia (PA) Police use a vague “good cause” standard to cancel permits to carry legal firearms. “It is a violation of the Second Amendment for government officials to use vague, personal discretion when determining whether to issue or revoke permits to carry firearms,” noted the Justice Department in a statement released by [AAG] Harmeet K. Dhillon. But it is a violation of the Second Amendment for government officials to require permits to carry firearms in the first place.
NRA Foundation.

- Last week we reported that a New York appeals court panel affirmed that former NRA EVP Wayne LaPierre still has to pay the NRA $4.3 million in restitution for his embezzlement and can’t serve in its leadership for the next decade. We also reported that the NRA Foundation – now taken over by LaPierre’s ousted NRA Board cohorts – announced it is formally changing its name to the 1791 Foundation as part of an effort to separate from the NRA. The move effectively admits to one of the NRA’s main contentions: the Foundation is no longer raising money with the primary intention of funding NRA projects. It also opens the door to a possible LaPierre return as a Foundation leader under this mask of separation. The court barred LaPierre from serving as a paid employee of the NRA or any group directly related to it for ten years. In the past, the Foundation has misspent funds as directed by LaPierre. Presumably that would no longer be the case since LaPierre is disbarred. But under the “new” Foundation — run by LaPierre’s contingent — all bets are off. As a past supporter and local NRA Foundation’s Friends of NRA committee member, I will NOT give anything to the Foundation, no matter its name, until all of this shakes out.
