Litigation

• U.S. v. Miller. 1939. The Second Amendment protects your right to military weapons, including but not limited to the M1903 Springfield bolt-action rifle and the M1 Garand semi-automatic rifle, both chambered for .30-06; the M1918 Browning Automatic Rifle, also in .30-06; M1, M1A1 and M2 carbines in .30 carbine; M97 12 ga. pump shotgun with a 20-inch barrel; M1921 Thompson submachine gun, M1911/M1911A1 semi-automatic pistols, and M1917 revolvers, all in .45 ACP.
• The US Supreme Court has turned away Carbajal-Flores v. United States, a challenge to the federal statute prohibiting illegal aliens from possessing firearms, but did not take action on two other cert petitions dealing with gun bans for those convicted of crimes punishable by more than a year in prison.
• But justices slated two additional cases for review in yesterday’s conference. Both cases – Vincent v. Bondi and US v. Duarte – were previously heard during the Court’s November 21 conference, but SCOTUS took no action on either when it released its orders from conference on November 25. Now it appears justices are ready and willing to take a second look at the appeals of Melynda Vincent and Steven Duarte. Both of these cases deal with the federal prohibition on gun ownership for those convicted of crimes punishable by more than a year in prison, even if those offenses are non-violent in nature. SCOTUS has already accepted two Second Amendment cases this term. Will they take more? Three 2A-related cases were already slated to be discussed in conference, and each could be the vehicle for the Court to finally weigh in on whether bans on commonly-owned arms like AR-15s and magazines that can hold more than ten rounds violate our Second Amendment rights. Two of the three 2A cases originally scheduled for this week’s conference involve magazine bans; Gator’s Custom Guns v. Washington and Duncan v. Bonta.
• Second Circuit Tees Up Another 2A Case for SCOTUS.
• On Thursday, November 20, the US Eighth Circuit Court of Appeals created its own standard to uphold the federal ban on machine guns. The court determined “As a threshold matter, an individual must be able to ‘carry’ the firearm under the plain meaning of the Second Amendment.” The case of United States of America v. Charles is an appeal out of the US District Court for the Western District of Arkansas – Fort Smith.
• A panel of the US Fifth Circuit Court of Appeals decided 2-1 that the federal law barring habitual drug users from possessing guns is unconstitutional as applied to a Mississippi marijuana user.
• The US Department of Justice under Attorney General Pam Bondi has formally defended the National Firearms Act in court, citing the Constitution’s Necessary and Proper Clause and the Commerce Clause as legal justification for firearm registration and regulation.
• And conversely, DOJ has also filed an amicus curiae brief arguing that Hawaii’s stringent “Vampire Rule” anti-carry law infringes on Americans’ constitutionally protected right to keep and bear arms. The law prohibits concealed-carry license-holders from carrying firearms onto private property that’s open to the public without the property owner’s express permission. So you could never leave the public street.
• The US Ninth Circuit Court of Appeals hit the reset button on California’s ammunition background check case on December 1, vacating a July ruling that struck down the state’s restrictive ammunition laws and ordering the case reheard by an 11-judge en banc panel. The law requiring a background check for every ammunition purchase stays in effect while the full panel reconsiders the case, with oral arguments scheduled for March 2026. The panel is expected to keep the clearly unconstitutional law.
• Thurston County, Washington Superior Court Judge Christine Schaller has erroneously held that “assault weapons” are not commonly used in self-defense and are therefore not protected arms under the Washington State Constitution.
• The National Shooting Sports Foundation – the firearms industry trade association – has appealed to the US Court of Appeals for the Fourth Circuit following the US District Court of Maryland’s decision dismissing NSSF’s lawsuit challenging Maryland’s law that intended to circumvent the federal Protection of Lawful Commerce in Arms Act.
• A California man is challenging the state’s ban on firearm silencers.

Studies

• The FBI tracks active shooting cases-where individuals attempt to kill people in public places, excluding those tied to robberies or gang violence. This study is the first to systematically compare how uniformed police and civilians with concealed handgun permits (or presumably otherwise legally armed – JP) perform in stopping these attacks. We find that civilians with permits reduce the number of victims killed, the number wounded, and the total number of casualties more than responding police officers do. They also stop the attacks more frequently and face a lower risk of being killed or injured than police.

Government

• FBI. Still an enemy. The FBI’s unconstitutional warrantless NICS Monitoring Program is judge-protected surveillance of law-abiding Americans whose only “crime” was buying a firearm legally.

Of course carrying your already-purchased property with you is not an interstate commerce or tax issue, and I can think of no constitutional authority for the government to be involved in the process whatsoever.

• The Department of Justice is opening a new office that will focus exclusively on gun ownership rights. The office, named the Second Amendment Rights Section, will be part of the Civil Rights Division and dedicated to upholding the right to bear arms, according to Harmeet Dhillon, who heads the division. We will see if this DOJ section can rein in the rest of the DOJ. I’m not holding my breath.

Other Enemies

• Why Do Police Unions Oppose Reciprocity? Because their leaders are evil and/or stupid. There. I said it.
• Chicago Mayor Brandon Johnson: Incarcerating Violent Criminals Is “Racist, Immoral, and Unholy.” My only response to that is, “load up.”
• US Rep. Ilhan Omar, the Somali congresswoman (D-MN), an example of everything an immigrant shouldn’t be, has issued a call for nationwide gun registration and confiscation, which she calls a “buyback.”

• Everyclown gun ban group accidentally admits that defensive gun uses are common.

Department of Idiocy

• An IT consultant was arrested by police in Britain after he posted a picture online of himself posing with a gun in the US. Let’s all post gun pix.
• More from the UK: Police take a shooter’s guns because “his wife has cancer.” You can’t make this up.
• Here it is. We found the dumbest thing on the internet. “All firearms out in public, on our city streets, should have visible trigger locks.” – John Zwier, assistant Minnesota attorney general.

The Only Ones

• USMC recruiter Ricardo Perez Castillo pleaded “no contest” to charges he stabbed an 11-year-old girl he planned to rape posthumously during a home invasion. He was caught and held at gunpoint by a homeowner. We note that most professional self defense trainers and cops do not recommend holding anyone at gunpoint or at all. One question to the antis: In that situation do you just call 911 and wait?
• Gulfport (MS) Police Sergeant Joseph Prine, Jr., 33, was arrested in Gatlinburg, Tennessee and charged with driving under the influence, violation of open container laws, and carrying a weapon while under the influence. Apparently Prine was in Tennessee for drug training and was driving his patrol car at the time of his arrest. Bright.

• Winchester Ammunition has officially opened a modern new office in Clayton, Missouri. The location accommodates nearly 70 full-time staff from the Winchester division, in addition to corporate support staff, including finance, technology, and human resources.

• The Firearms Research Center in the University of Wyoming’s College of Law has received a nearly $1 million grant from the US Department of Education to develop a national program that will provide secondary school teachers with nonpartisan, historically grounded content on the origins, legal interpretation and civic implications of the Second Amendment.
• The US Secret Service has issued a Request for Information for a new suppressed 5.56x45mm duty rifle.

While copper may be an approved material for waterfowl hunting, we note that copper is toxic to marine life. I have an interesting story from my engineering career with a government environmental agency about that.

• J.P. Sauer & Sohn and Field Ethos introduce their latest collaboration – a limited-edition Sauer in 9.3×62 named The Exception. The 9.3×62 cartridge was specifically designed for European Settlers in Africa who needed a more potent hunting cartridge to handle the unique species on the continent. This caliber is one I’ve long wanted but never had. $2700.

• Savior Cases.
• The MDT Hand Cannon Slingshot is built from CNC-machined anodized 6061 aluminum and designed around a fully modular architecture, allowing adjustment and customization, including integrated Picatinny rails, sling studs, and bolt-on sight interfaces to add lights, lasers, SEND iT levels, lanyards, and other accessories.
