- Breaking: FBI Director Kash Patel confirmed that NICS Monitoring was (illegally) used to track firearm purchases by Americans who remained legally eligible to buy guns. Further, the government tried to suppress information about the secret program.
- Update: US District Judge Deborah K. Chasanow granted a preliminary injunction against Montgomery County, Maryland’s ban on concealed carry in houses of worship. For now, it only covers the plaintiffs.
- US District Judge Maryellen Noreika has ruled that Delaware’s ban on possessing unserialized firearms and privately manufacturing guns facially unconstitutional on Second Amendment grounds and entered final judgment for the plaintiffs — the Firearms Policy Coalition and two Delaware gun owners. She’d already granted a preliminary injunction against those provisions back in 2022. The case is Rigby v. Jennings. We suspect the state will appeal.
- Texas admits its carry bans at racetracks, 51-percent alcohol establishments, and sporting events are unconstitutional but asks the US Fifth Circuit to dismiss the challenge without blocking enforcement. It seems everything is bigger in Texas, including the gall.
- The US First Circuit Court of Appeals is hearing a case challenging Massachusetts’ multi-layered handgun roster scheme that prevents licensed dealers from selling many popular pistols commonly available across the rest of the country. During September 9 oral arguments in Granata v. Campbell, one judge cut directly through the Commonwealth’s defense that hundreds of other handguns remain available: “How many can you ban before it’s a ban?”
- Gun Owners of America, Gun Owners Foundation, and Cynthia Ladd filed a federal lawsuit on September 11, 2026, challenging Oregon laws that prevent most nonresidents from obtaining an Oregon Concealed Handgun License while refusing to recognize carry permits issued by any other state. The case, Ladd v. Hunter, was filed in the US District Court for the District of Oregon. I suspect this case will be a big one.
- Plaintiffs residing outside of New York are challenging a Manhattan regulation that limits carriers to a single firearm. The challenge was raised in the US District Court of Southern New York.
- Important: Fifth Circuit case argues that the Commerce Clause cannot justify bans on intrastate, noncommercial conduct. If successful, the ruling will “have massive import for federal law,” undermining “much of the United States Code.” As it should. If you read the US Code alongside the US Constitution, you will find that probably 90% of federal laws and regulations are simply unconstitutional.
- SCOTUS Gun Watch 9/15/2026. The Court’s next conference is scheduled for September 28th, when the Justices presently plan to discuss 57 firearms-related cases.

- The District of Columbia’s attorney general is taking sides against the current leadership of the National Rifle Association in its legal battle with its own charitable foundation, now called the 1791 Foundation, formerly the NRA Foundation.
