Action item

  • Sign the petition opposing ATF’s new rule that would require a Federal Firearm License and a background check on ANY firearm transaction where the ATF deems that any kind of “profit” is made. In other words, no more private sales, plus gun registration.

Litigation

  • The U.S. Supreme Court will hear oral argument on Nov. 7 in United States v. Rahimi, a challenge to the constitutionality of a federal ban on the possession of guns by individuals who are subject to domestic violence restraining orders.
  • U.S. District Judge C.J. Williams found an Iowa man’s challenge of the federal law barring drug users from owning guns failed. He ruled the ban doesn’t conflict with the Second Amendment and that the charge against the man for owning guns while using marijuana could stand, and cited a previous 8th U.S. Circuit Court of Appeals decision.
  • Meanwhile, Hunter Biden will be indicted in Delaware on federal felony charges for both lying on the ATF form he completed to obtain a gun and his possession of it while allegedly using crack cocaine. Don’t hold your breath on a prosecution. Hunter will likely argue that the charges are unconstitutional under the Bruen decision.
  • Cops vs. Constitution
  • In an 11-year-old case torturously attempting to tie commercial waste rules to professional hunting guides, the 9th U.S. Circuit Court of Appeals rejected a suit (decision here) by the Center for Biological Diversity, Sierra Club, etc., to order the U.S. Forest Service to ban the use of lead ammo in the Kaibab National Forest, which adjoins the Grand Canyon and is a popular big game hunting destination.

  • Pedro Cruz Almeida, 22, was sentenced in federal court to 50 months in prison for his role in helping smuggle thousands of rounds of 50 caliber ammunition into Mexico for a cartel. Almeida was a cadet at a local police academy in the Hidalgo County, TX, area.

Constitutional Nebraska

  • Anyone who is legally able to purchase and own a handgun in the state of Nebraska can now legally conceal it in their clothing or their car without a permit, and without a safety training course. The new law comes with the usual babble from leftists and LEO bigheads about leaving them out of the “safety training” loop and “blood in the streets,” and whatnot. Won’t happen. Some municipalities are putting up gun ban signs in defiance of the state’s new preemption law that accompanied the new constitutional carry law.
  • That makes 27 states that have legal, permitless gun carry.
