Litigation

A three judge panel from the US 10th Circuit Court of Appeals in Denver said a lower court was right to reject a request from Clark Aposhian to temporarily block last year’s Trump Administration bump stock ban, because he did not show he was likely to win his case. The appeals court also said he failed to show that blocking the ban would not hurt the public’s interest. The appeals court and the lower court are wrong. Gun parts bans are infringements.

A three-judge panel from the US 9th Circuit Court of Appeals ruled this week that California’s requirement for background checks on all ammunition purchases can remain in place while the law is being challenged, overturning a district judge’s decision to block the background checks during the litigation. We note that background checks are also an infringement.

The US Supreme Court ruled last week that it is a crime to encourage illegal aliens to remain in the US unlawfully. But judging by what’s actually going on, it seems that it is not a crime to actually be in the country illegally.

A man has sued the ATF for damaged, missing guns that they seized. ‘Bout time. Agencies should be liable for every single scratch, nick and dust particle appearing on guns seized from folks who legally owned them at the time.

Police

This was National Police Week. Thank you, officers and families.

About those blue-on-black shootings:

  • Only 13% of the situations in which officers are legally justified in using lethal force result in a citizen death.
  • Only 8% of the situations in which officers were legally justified in using lethal force against an African-American male result in a death.
  • While African-American men make up 44.3% of assailants against the police, they only make up 26.3% of the deaths from legal interventions.

Virus

Three states (New York, New Jersey, and Massachusetts) have a combined 42,326 deaths from COVID-19, which is nearly half of all US deaths from the disease. All three of those states voted for Hillary Clinton by landslide margins. Hmmmm…

During a push to accelerate the review of parole-eligible inmates because of the coronavirus pandemic, Virginia released dozens of violent offenders, including killers, rapists and kidnappers.

Meanwhile in New York, over 100 inmates who were released from Rikers Island prison due to coronavirus concerns have been arrested again.

We have a report that since the pandemic began, there’s been a huge increase in numbers of dog bite cases.

About those masks.

I went into my bank last week, wearing a hat, mask, and gun. Yet I only took my own money. Go figure.

Broward County (FL) Sheriff’s Sergeant Brian Miller, who was fired for “neglect of duty” after he hid behind his car at the start of the 2018 shooting at Marjory Stoneman Douglas High School, will be reinstated with full back pay and return to his rank, according to the Broward Sheriff’s Office union.

Two points:

  1. In today’s world, labor unions are evil; more often representing the morally wrong side of labor situations.
  2. Government agencies and many of their employees DO NOT CARE about your well-being.

Maine State Trooper George Loder is suing the Maine Intelligence Analysis Center, and its supervisors, claiming he was demoted after he told his bosses that the center was collecting and maintaining data illegally, including information about people who had applied to buy guns from firearms dealers.
