ATF vs Paris, Nightclub, TN Law, Zones, Bracken Essay

2A News: July 1, 2016 Newsletter by Jeff Pittman

The Gift That Keeps On Giving

Remember the Paris terrorist massacre (130 dead, 368 wounded)? Remember the ATF’s felonious Fast & Furious gun running scheme (body count still rising)?

Well, guess what?

Judicial Watch has learned that apparently one of the guns (an AK-style rifle) used in the November 13, 2015 Paris terrorist attacks came from Phoenix, Arizona where the Obama administration illegally armed known criminals with thousands of weapons in ATF’s F&F debacle.

A Report of Investigation (ROI) filed by an ATF agent tracked the gun used in the Paris attacks to a Phoenix gun owner who sold it illegally, “off book,” and who had other, illegal, machine guns. But no enforcement or prosecutorial action was taken against the individual. Instead, ATF leaders went out of their way to keep the information under the radar and keep the person’s identity secret. A LEO said that “Agents were told, in the process of taking the fully auto, not to anger the seller to prevent him from going public.” Because we can’t have transparency in this administration, I suppose.

Litigation

SCOTUS has ruled in the case of Voisine v. United States to uphold the federal gun ban on individuals convicted of domestic violence with one distinct clarification. In their 6-2 decision made Monday, liberal Justice Kagan writing for the majority said:

“Federal law prohibits any person convicted of a ‘misdemeanor crime of domestic violence’ from possessing a firearm. 18 U. S. C. §922(g)(9). That phrase is defined to include any misdemeanor committed against a domestic relation that necessarily involves the ‘use . . . of physical force.’ §921(a)(33)(A). The question presented here is whether misdemeanor assault convictions for reckless (as contrasted to knowing or intentional) conduct trigger the statutory firearms ban. We hold that they do.”

In other words, an accident could result in a gun ban. Conservative Justice Thomas and liberal Justice Sotomayor dissented. Sotomayor thought that the law wasn’t restrictive enough, saying “Minor uses of force may not constitute ‘violence’ in the generic sense, but even a small act of forcible touching is easy to describe as ‘domestic violence,’ when the accumulation of such acts over time can subject one intimate partner to the other’s control.”

Liberal US House Democrats hit with ethics complaint over sit-in. Well, that is their one part they know how to use.

The US House, led by House Speaker Paul Ryan (R-WI) is supposed to vote on some gun control bills next week.

Aliens

The US Citizenship Oath of Allegiance no longer requires naturalized citizens to swear to “bear arms on behalf of the United States.”

Border control. It really is that simple.

Turkey

At least 42 people have been reported killed and 238 injured by a triple suicide bombing at Istanbul’s Atatürk International Airport. Before the bombs, the attackers used “illegal” AK-style rifles to shoot up the place. This was the deadliest of five bombings in Turkey’s biggest city so far this year.

But Turkey’s gun laws are “restrictive” (i.e., onerous), just like the liberals here want. Civilians are not allowed to possess automatic or semi-automatic firearms. Or bombs. For other firearms, background checks, licensing and registration, including a “genuine reason” to possess, are required.

So that gun control thing that’s supposed to prevent terrorist massacres? Ain’t happenin’. In fact, Turkish police officer Yasin Durna, who faced down and shot one machine gun-wielding terrorist just before the attacker detonated a suicide bomb, was hailed a hero by airline officials.

CIA Director John Brennan said the attacks looked like ISIS and warned that the terrorist group wants to conduct similar large-scale attacks in the US.

Another nightclub massacre

No, not Orlando. Did you hear about the nightclub massacre in South Carolina this week, perpetrated by a 32-year old “suspect” with a gun? No?

Maybe because he got shot by one of his victims after he shot only three people, none fatally. That’s 3 with recoverable injuries, vs. 49 dead and 53 wounded in the Orlando nightclub. CCW works.

Tennessee gets it

Starting today, if a handgun carry permit holder in Tennessee is injured, suffers bodily injury or death, incurs economic loss or expense, property damage or any other compensable loss on a property voluntarily posted as a gun-free zone, they can sue the person or entity who chose to make them defenseless —

Because the sign-poster “thereby assumes absolute custodial responsibility for the safety and defense of the permit holder while on the posted property and while on any property the permit holder is required to traverse in order to travel to and from the location where the permit holder’s firearm is stored,” and that responsibility “shall extend to the conduct of other invitees, trespassers, employees of the person or entity, vicious animals, wild animals, and defensible man-made and natural hazards.”

Pretty cool. I don’t see any explicit requirement that the victim actually has to have obeyed the sign and disarmed himself for the law to apply.

MS GOP senator complains

Meanwhile back in Mississippi, state senator Brice Wiggins (“R” — Jackson County) complained about all the pro-gun bills during this year’s legislative session, apparently because that was interfering with more important legislative business. Well, if the legislature hadn’t interfered with our rights in the first place, which was none of their business, we wouldn’t need all this corrective legislation. And although there certainly may be more appropriate issues for the legislature, there’s hardly anything more important that the rights of the people.

Tell you what, Brice. Introduce and get passed just one bill to repeal ALL the gun control laws in the state, and we’ll both be happy, OK?

DGUs

Mom with 2 small children finds home invader in child’s room, calls cops and waits.

Not really. She shot him.

Crazy man demands entry into strange house.

Upon refusal, man breaks in, and chases female resident upstairs to bedroom.

Resident locks bedroom door and calls 911.

Man breaks into bedroom.

Woman locks herself in closet.

Man, now naked and smeared with his own poop, breaks into closet, where the woman is still waiting on the cops.

She shot him. So much for 911.

Florida attacks

Sanford, FL, Mayor Jeff Triplett was carjacked while standing outside his home early last Saturday when three males approached, pointed a gun at him and stole his car keys and wallet before driving off in his Mercedes. Police arrested an 18-year-old and a 17-year-old suspect, but the third suspect has not been caught. Apparently police also withheld his description. The captured 18-year-old thug in the released photo looked a lot like the perp who died while viciously attacking a neighborhood watchman in Sanford a few years ago.

Meanwhile in North Port, FL, Noah Dassat, 33, of Santa Cruz, CA, has been arrested on four felony charges and one misdemeanor for armed burglary, battery, and criminal mischief after he allegedly broke down a door and invaded a home armed with a baseball bat and attacked the occupants — including 3 children. But a male resident wrestled the suspect and put him in a bear hug so that the wife could take the bat away and beat the snot out of the perp’s head. The perp then fled without the bat, his hat, and lots of blood. He was later arrested at a hospital. I guess she didn’t hit him hard enough.

I’m thinking that consistent with the laws in many jurisdictions that provide for criminals to be charged with murder if anyone, including one of their own, dies during their felony, this guy should similarly be charged with counts of assault and battery and littering (for the blood) for his own injuries, which occurred as a result of his crime.

The Only Ones

Fort Lauderdale, FL, Fire Rescue firefighter/paramedic Stefanie Silk, 31, of Margate; Plantation, FL, Police officer Cejay Rene Hammack, 28, of Cooper City and Christopher Majeske, 40, a restaurant owner from Cleveland, TN, face eight counts of felony reckless endangerment after being arrested in Tennessee after deputies accused them of striking three occupied homes with bullets during late-night target practice.

Friends

“I will not agree to efforts that violate Second Amendment rights. It is my responsibility and privilege to adhere to the Constitution. When the Senate recently voted on measures relating to the purchase of firearms, I opposed three amendments that would have needlessly eroded our constitutional freedoms: I voted against the Murphy amendment to expand background checks to transfers between family members, the Feinstein amendment, and the Collins-Ayotte ‘compromise’ amendment. The latter two amendments would have used federal terror watch lists to deny Second Amendment rights without due process.” — US Sen. Roger Wicker (R-MS), 6/30/2016

Enemies

We have yet another report that the Obama administration has been “riddled with Muslims who are anti-American in their views in key national security positions,” such as Cairo-born Gamal Abdel-Hafiz, who immigrated to the US in 1990 and worked at the FBI for 22 years, including “consulting” on “countering violent extremism.” Abdel-Hafiz is calling for a national gun registry for law-abiding citizens in clear violation of the Second Amendment.

Gosh, he could be president.

extremist guns

Catholic Archbishop Blase J. Cupich of Chicago and Bishop Kevin J. Farrell of Dallas have called for a ban on the sale of military-style semiautomatic firearms, saying they have no place in the hands of civilians. That’s probably what they said in 1937 Germany and Poland. And did the bishops tell the Pope to disarm his machine-gun-armed Swiss Guards?

Cinemark, owner of the “gun free” Aurora Century 16 movie theater where 12 people were killed in a 2012 mass shooting, is seeking reimbursement of nearly $700,000 in legal fees from victims and their families, who sued the theater chain for not hiring armed guards, not having enough security cameras, and generally failing to protect theater-goers from the killer. An Arapahoe County jury ruled against the victims last month, clearing the way for Cinemark to seek reimbursement for $699,187 in legal costs.

Dept. of Idiocy

Maybe you heard about the “active shooter” scare and lockdown at Joint Base Andrews outside Washington, D.C. Turns out somebody saw cops carrying guns and called the police… on the police. These people vote, folks.

“An ‘assault weapon’ is the Sicilian widow of the firearms world: a little scary-looking and all dressed in black.”

The Walmart Rule. Genius.

Step 1: Go to Walmart to find out what kinds of ammunition they normally stock.
Step 2: Buy all the guns needed to fire all the ammunition sold at Walmart.
Step 3: Pick up one box of ammo every time you go to Walmart.

FBI pistols

It looks like Glock has won the FBI’s $85 million contract for 9mm pistols. We don’t yet know which model, but the solicitation specs suggest Glock will be supplying Glock 19 and Glock 17 pistols, along with inert training pistols, a Simunition training pistols, and replacement parts. The contract reportedly may also be used to supply law enforcement officers for 11 other federal agencies.

The FBI has issued handguns in .38 Special (later including the famous “FBI load — a +P 158 gr. LSWCHP), .38 Super, .357 Magnum (145 gr. Silvertip), .45 ACP, 9mm, 10mm — resulting in the “10mm Lite” FBI load, which gave birth to the next cartridge in the Bureau succession — the .40 S&W, and now, back to 9mm.

The new service load is reported to be the Speer 147-gr. Gold Dot G2.

New SAAMI cartridge

The Sporting Arms and Ammunition Manufacturers’ Institute (SAAMI), the firearms and ammunition industry’s technical standards-setting organization, recently announced the acceptance of a new cartridge and chamber standard, the 6.5-300 Weatherby.

Products

  • Patriot Ordnance Factory’s (POF) new Revolution AR-style rifle in .308 weighs just 6.2 lbs. — they say the same size and weight as a 5.56 AR-15. Very useful.
  • Solutions De Innovation LLC has introduced the Feed Tube Selector Switch (FTSS) for the Kel-Tec KSG dual-mag-tube shotgun. The FTSS replaces the standard tube selector by extending below the ejection port and turning a corner to rest near the firing hand. $96.50.
