Litigation

• The Second Amendment Foundation and Firearms Policy Coalition have filed a lawsuit challenging the ban on firearms possession in federal facilities operated by the National Park Service. Filed in US District Court for the Northern District of Texas, Fort Worth Division, the lawsuit specifically challenges the constitutionality of federal law 18 U.S.C. § 930(a), which bars knowingly possessing a firearm in a federal “facility,” as applied to federal facilities operated by the National Park Service. The law defines a federal facility in the National Park System as “…government offices, visitor centers, ranger stations, fee collection buildings, and maintenance facilities.” A ludicrous example of this is that on the Natchez Trace Parkway, travelers can carry all along the parkway, except when they stop at 3 a.m. at a very secluded, very dark, very solitary rest stop where they have to leave the gun in the car before they go pee, to be legal. Park officials themselves are also reportedly allowed to impose park-specific restrictions on where firearms may be carried, though it was my understanding that National Parks allowed carry the same as state law allowed for state parks in the same state where the National Park is, except for federal “facilities.”
• On Monday, a federal judge dismissed all plaintiffs but one in a court case challenging Washington, D.C.’s standard capacity magazine ban. In this case, Andrew Hanson et al. v. District of Columbia et al., US District Court Judge Rudolph Contreras granted in part and denied in part the District’s partial motion to dismiss. The judge dismissed all the plaintiffs from the case, except one, leaving him to go in alone to defeat the unconstitutional ban.

Government

• USPS. On Wednesday, the United States Postal Service released a new proposed rule in the Federal Register that would reclassify handguns as “mailable” under its regulatory standards. The USPS said the change was necessary to conform with a recent Justice Department Office of Legal Counsel guidance that found the restrictions violated the Second Amendment. Well, they never should have banned mailing handguns in the first place, but considering how much mail is “lost,” perhaps you should find another way.
• ATF. ATF Releases 472-Page Guidance Document Clarifying What a Gun Is. I can write a 500-page thesis on why the ATF shouldn’t exist.

NRA

• How can we miss her if she won’t go away? During a deposition earlier this month as part of her lawsuit against the NRA, former NRA president Marion Hammer — one of disgraced former NRA EVP Wayne LaPierre’s most ardent acolytes — allegedly used profanity and became somewhat combative.

Enemies & Liars

• The head Brady Buncher says she doesn’t question your Second Amendment rights. Big fat lie.
• Gun-banning liberal Chicago Mayor Brandon Johnson (D) is spending taxpayer dollars to the tune of some $30 million a year for a personal armed security detail that includes as many as 150 Chicago Police Department officers while at the same time presiding over some of the most egregious gun laws in the nation. I doubt he’s worth it.
• The Hunting Community Is Losing the Public Relations War—and That Must Change. It would also help if state game management agencies would quit promulgating minutial rule after rule after rule prescribing HOW you must hunt, right down to shot size, optics, magazines, time of day, wind direction, moon phase, and executive whim.

The Only Ones

• An unidentified on-duty Secret Service agent on Jill Biden’s detail shot himself in the butt while escorting the former first lady through Philadelphia International Airport last week. One report states, “The agent was only one week on the job with the Jill Biden detail. He was in the SUV behind the one Biden was traveling in. He left to accompany Jill Biden through the airport, but soon realized he forgot his cell phone.
• The agent rushed back to get it, and his pistol fell out of the holster and was lying on the seat. He grabbed his pistol quickly and negligently fired it as he was trying to put it back in the holster. The agent shot his butt cheek.” Ah, but a later report clarifies: “He rushed back to get his cell phone and was using his Glock’s flashlight to try to find it in the trunk of the SUV. When he tried to holster his gun, he shot himself.” He probably should have left his bullet in his shirt pocket.
• Kelsey Fitzsimmons, a 29-year-old former North Andover, MA, police officer was found not guilty of attempting to shoot a brother in blue after she testified in her defense that she was only trying to kill herself as officers arrived at her home to serve a restraining order filed by her ex-fiancé.
• Newly-promoted Mount Vernon New York detective, Kyren Braunskill, 34, has been arrested and charged with supplying guns to the Long Island 48 Gang.
• Boston Police Officer Sean Cullen, 45, has been charged with a felony count of improper storage of a large capacity firearm and a misdemeanor count of improper storage of a firearm, after fellow officers found a loaded gun loose in the front seat of his vehicle. The officers went to his home last December following an argument between him and his girlfriend.
• USMC Corporal Andrew Paul Amarillas, an Arizona native who served as an ammunition technician at Camp Pendleton, is accused of making off with a pile of restricted military weapons, including Javelin missile systems and military small arms ammo.

• “Just call the police.” Well, the cops were called and were actively on the manhunt. In fact, they were close enough to hear the shots. But a homeowner still had to do the job.
