Litigation
- A lawsuit has been filed in the US District Court for the District of New Jersey by New Jersey gun owner Heidi Bergmann-Schoch along with the Coalition of New Jersey Firearm Owners, Gun Owners of America, and Gun Owners Foundation. The plaintiffs are challenging clearly unconstitutional New Jersey statute N.J.S.A. § 2C:39-3(f)(1), which criminalizes possession of what the state calls “hollow nose or dum-dum” bullets in most public settings.
- ATF Says Brace Rule Case Is Moot, Warns Some Braced Pistols Still Face NFA Enforcement. I’m just a simple guy and I don’t really understand the whole issue here. Either a firearm is a pistol, or it’s not.
- When Glock announced a major redesign of most of its lineup and the retirement of older models last year, the assumption was that it was done in response to both legislation and litigation aimed at blocking the sale of some of the most popular handguns in the country. By getting rid of the cruciform trigger bar, installing an illegal switch that converts a semi-automatic pistol into a full-auto machine gun becomes more difficult, at least in theory. The changes, though, haven’t stopped anti-gun politicians from continuing to target the gun maker. Last Friday, Philadelphia became the latest city to initiate a lawsuit against Glock, and the first one to do so since the company announced its design changes.
- The State of California is suing Second Amendment attorney Matthew Larosiere over the distribution of instructions and 3-D models for printing of firearms. Interesting article.
- Four years ago the State of California banned advertising firearms related products to minors. California lost the First Amendment lawsuit and has to pay the plaintiffs $1.38 million in legal fees. The fees will not cost those who filed the bill and voted for the law, or those who defended the law in court, any money at all. They’re spending other people’s money.
- From the US Ninth Circuit’s January decision in Baird v. Bonta, which ruled that California’s ban on open carry in counties with a population of greater than 200,000 violates the Second Amendment: “If a state by statute categorically banned drivers’ licenses for 95 percent of the state’s drivers, or for 95 percent of the roads in the state, it would be quite strange to characterize that as a mere ‘licensing’ regime. We would have no trouble recognizing such a characterization as classic Orwellian doublespeak.” – Judge Lawrence VanDyke, 9th Circuit
- A federal court in Texas this week held in favor of the FPC, SAF and their partners, confirming that all current and future members of the organizations are covered by the injunction granted in a case which prevents the enforcement of the post office carry ban at most ordinary US Post Office locations. The court denied a DOJ motion to confine the ruling to organization members as of the date the suit was originally filed, and who had been identified to the government by the organizations. As Judge O’Connor explained, “it is hard to envision that the Founders would countenance banning firearms in the post office—particularly because they did not do so themselves.” The case remains under appeal. When the ruling was originally issued, I started always carrying my SAF membership card right along with my CCW permit, just for this reason. The SAF is one of the few pro-2A groups I contribute to, and I am a Life Member.

- How the machine gun ban came to be. An excellent explanation. Folks, I stayed up all night back in April 1986 watching this debacle on C-Span. I won’t forget the clearly corrupt past-midnight procedure to enact an unconstitutional law, and I never forgot disgraced Charles “Who the hell wants to live in Mississippi?” Rangel. Video included.
- Canadian government sources indicate that “the current known, documented cost to the taxpayer” per gun surrendered or confiscated under Canada’s gun ban is approximately CAD$25,000, with the “undocumented cost being even higher” because the “costs accrued by more than a dozen partner agencies” involved haven’t been included. Apparently a majority of Canada’s law enforcement agencies are refusing to prosecute the federal government’s ban.

Attack follow-ups

- The Department of Justice charged a Virginia man last Friday for allegedly selling a stolen firearm to the ISIS-inspired Old Dominion University attacker. Authorities previously caught him illegally straw purchasing three firearms during the Biden administration but declined to prosecute the 10-year (times three) felony, instead asking the ATF to give him a straw purchaser warning letter, according to the affidavit and a senior DOJ source.
- Old Dominion Terror Attack Exposes the Myth of Gun Tracing.
- The FBI confirmed that the man accused of attacking a West Bloomfield temple died after shooting himself in the head. The terrorist suspect, a naturalized US citizen born in Lebanon, drove a truck into Temple Israel in West Bloomfield Township on March 12. After an exchange of gunfire with the temple’s security, he died at the scene. One security officer was taken to a hospital after being struck by the truck.

- Virginia Democrats Attempt to Exempt Legislators From Their Own Gun Law.
- A suspect who worked security for anti-gun Congresswoman Jasmine Crockett (D-TX) was shot and killed in a Dallas SWAT standoff last Wednesday when officers attempted to serve multiple felony warrants and a parole violation warrant on him for impersonating a police officer and stolen license plates. The man was working for Crockett under a false name and was armed with a stolen gun. He had previously been arrested several times and was on probation. The Giffords gun ban group had hailed Rep. Crockett as “a champion who will always stand up to the corruption of the gun lobby.”
- Democrat Virginia State Delegate Garrett McGuire: “We know that it’s not always true that you need a gun to fight back someone with a gun. Because those hero cadets didn’t. Leivu Labrescu, …didn’t have a gun when he selflessly gave up his body to prevent the Virginia Tech shooter from entering his class.” It’s true. You don’t need a gun to die.
- A new group called Bridging the Divide on Firearms Policy claims to be a “coalition of stakeholders who represent many perspectives on firearms in America” that is “dedicated to working together to reduce gun harms while respecting the rights of responsible gun owners.” Nope. Just another gun control gang.
- Perhaps gun-banning California Governor Gavin Newsom (D) can’t pass a background check.

- Liberals reportedly lost their minds* after pro-gun activists outside the Virginia State Capitol handed out free new 30-round AR-15 mags to folks, as the state government inside was about to ban them. Mags supplied gratis by MagPul, who sent a full pallet. *I don’t believe this story, since that side doesn’t have minds.
The Only Ones
- A man who was shot by police and later died had to wait 10 extra minutes for an ambulance after another officer having a “mild anxiety attack” took the first one that arrived at the scene. Bridgeport, Connecticut Police Officer Erin Perrotta, who had been involved in the foot chase, declined treatment in the ambulance, saying “I am fine, I just needed to get out of here.”

But my full-sized FN 509 Tactical is just one-third as large and I can carry it in a typical IWB holster and with just one spare magazine it offers 49 rounds. I can’t see going to an 18-inch long gun that can’t be holstered to pick up one more round.
