- A three-judge panel from the US Court of Appeals for the Fifth Circuit this week reissued a significant ruling in the case of United States v. George Peterson, affirming the conviction of George Peterson, a Louisiana firearms dealer, for possessing an unregistered suppressor in violation of the National Firearms Act (NFA), and therefore upholding the NFA’s alleged constitutionality.
- A divided three-judge panel for the US Ninth Circuit Court of Appeals upheld the conviction of an Oregon man who transferred a World War II–era Russian machine gun to an undercover federal agent. The panel rejected arguments that his transfer fit within an exemption for transfers to government employees. It also held that federal restrictions on the sale or transfer of unregistered machineguns don’t violate his gun rights. Apparently the court did not research the definition of “infringed.”
- North Carolina Woman’s Lawsuit Gives SCOTUS a Chance to Establish National Reciprocity. I think this is probably the wrong direction. Instead of reciprocity of infringements, we need to have nationwide adherence to the Constitution. But I suppose we take whatever we can get.
