A Right Denied
- The federal government shutdown has halted the processing of NFA firearms approvals, such as those for suppressors and short-barreled rifles, and left law-abiding gun owners across the country facing potential delays. I understand that the NICS check system for regular gun purchases is still operational, but have no firsthand experience since our CCW license circumvents that particular infringement.

- Dangerous and unusual.
- The US Supreme Court took up its next Second Amendment case last Friday, agreeing to hear Wolford v. Lopez, a challenge to Hawaii’s statutory ban on carrying concealed weapons on private property without the owner’s express consent.
- The US Supreme Court on Monday declined to hear Missouri’s case that sought to declare the state a gun sanctuary that negates federal firearms restrictions.
- US District Judge Corey L. Maze of the Northern District of Alabama’s Eastern Division has ruled that portions of the Bureau of Alcohol, Tobacco, Firearms and Explosives’ (ATF) 2024 Final Rule on firearm dealing exceed the agency’s statutory authority. In the case, Butler v. Bondi, plaintiffs—including individual gun enthusiasts Don Butler and David Glidewell, along with the National Rifle Association (NRA)—challenged the rule’s broad interpretation of what it means to be “engaged in the business” of dealing firearms under the Gun Control Act (GCA). The Biden ATF’s Final Rule, effective April 19, 2024, aimed to clarify and expand the definition of unlicensed firearm dealing and sought to require federal licenses for anyone “engaged in the business” of selling guns, even if not for primary profit. Maze’s ruling applies to the two plaintiffs and to members of the NRA.*

- The CCRKBA, joined by the FPC Action Foundation, Texas State Rifle Association, Hot Shots Custom, and three Texas private citizens, have filed a federal lawsuit in US District Court for the Northern District of Texas, Amarillo Division, challenging the constitutionality of the National Firearms Act “with respect to the untaxed firearms it purports to regulate” and “with respect to suppressors and short-barreled rifles” on Second Amendment grounds. Defendants are the BATFE, the Department of Justice, and Acting ATF Director Daniel P. Driscoll and Attorney General Pamela Bondi, in their official capacities.

- Update on USPS ruling: “The Postal Service is aware of the recent decision by the U.S. District Court for the Northern District of Texas regarding the ban on firearms possession on postal property, which enjoins enforcement of the ban at certain Post Offices, and the surrounding Post Office property, with respect to certain postal customers. The Postal Service is currently analyzing the court’s decision AND TAKING NECESSARY STEPS TO IMPLEMENT THE INJUNCTION.”

Jones is now in trouble for suggesting a political rival should have been shot in the head along with his children. Further, Del. Carrie Coyner says Jones told her in a 2020 phone call that a few police officers dying would stop them from killing other people. While Everytown’s endorsement announcement has disappeared from their website, there’s been no announcement the endorsement was withdrawn, and no word about whether Everytown has asked the Jones campaign to return the contribution. Perhaps they still support him but just want to hide it.

- (Printed in entirety due to paywall.) A 20-year-old Tupelo (MS) man is being held with bond, charged with first-degree murder in the early Wednesday morning (last week) shooting of his stepfather. Jermaine Morris reportedly saw his stepfather choking his mother in the kitchen and fired at least a dozen 40-caliber rounds at Cornelius Spearman, 36, as he ran out of the house. Spearman was struck by multiple bullets and was pronounced dead at the scene before dawn. Defense attorney Drew Stuart said this is a case of self defense. His client was trying to protect his mother. “When a person is no longer a threat and fleeing, you don’t keep shooting,” said Tupelo Municipal Court Judge Willie Allen. “That goes beyond the defense of others.” Tupelo police detective Evan Hannon said officers were called to the 1800 block Simpson Drive Oct. 1 around 4:25 a.m. Wednesday. He testified that Morris’ mother, April Morris, said she and Spearman got into an altercation in the kitchen, where Spearman hit her with a closed fist. She said her son intervened and shot Spearman inside the residence and when he tried to run outside. After the shooting, Morris got in his mother’s car and fled the area, heading to Houston where his girlfriend lives. She later brought him back to Tupelo. He turned himself in at the police station around 11:45 a.m. and gave a statement to detectives. “He said he was in his room working on his mother’s gun when he heard the altercation getting louder,” Hannon testified. “He walked into the kitchen and saw (Spearman) hunched over and could later see he had hands around his mother’s neck choking her.” Morris told police he pointed the gun at Spearman and told him to stop. When that didn’t work, he fired a warning shot. He then started shooting at Spearman. “He couldn’t remember how many times he fired at Spearman,” Hannon said. “He thought he fired until the gun ran out of ammunition or the gun jammed.” Detectives found four spent casings on the back porch and six more in the backyard. A total of 12 shell casings were located. Morris’ defense attorney said Spearman had “a propensity to violence” and been convicted of at least nine felonies — including aggravated assault, burglary, trafficking stolen guns and weapon charges — as he reiterated the idea of self defense while asking for a reasonable bond…
