Litigation
- In the cases Barnett v. Raoul, the US Department of Justice in June filed an amicus brief with the US Seventh Circuit Court of Appeals, not in support of the state, but of the plaintiffs suing to have Illinois’s “assault weapon” ban overturned. You read that right – the DOJ is asking the circuit court to affirm the district court’s injunction against enforcing the gun ban law.
- Also in Illinois, which is the only state with a complete ban on suppressor usage, Judge David W. Dugan with the US District Court for the Southern District of Illinois ruled that suppressors are not “arms,” and consequently, their ownership is not protected under the Second Amendment.
- A New York federal district judge has ordered the state to pay $837,636.50 in attorney’s fees to the plaintiffs who successfully challenged its “places of worship” carry ban. In my mind, it is exceedingly clear that any sort of government restriction on guns in churches that says you can’t legally do something in a church that you can legally do off church property is completely unconstitutional under the First Amendment’s protection of religious freedom. Mississippi also has a church gun ban, except for enhanced carry permit holders.
- The US Third Court of Appeals ruled this week that several provisions of New Jersey’s restrictive carry law – the ban on carrying firearms in private vehicles, the default ban on carrying on private property without explicit permission, the requirement that gun owners carry $300,000 in liability insurance, and the $50 surcharge on handgun carry permits for the Victims of Crime Compensation Office are likely unconstitutional. The court also defied the SCOTUS Bruen decision and found many of the bogus “sensitive places” bans constitutional. The case, Koons v. Platkin – brought by the Firearms Policy Coalition, Second Amendment Foundation, and other plaintiffs challenging New Jersey’s Bruen response law. The plaintiffs are expected to request an en banc hearing for the case, in which the full Third Circuit would hear the suit. If the full court makes the same decision, I believe the case will be remanded back to federal district court and can be appealed to the Supreme Court.
- The US Tenth Circuit Court of Appeals has ruled in an Oklahoma case, United States v. Harrison, saying that the sweeping federal gun ban on marijuana users violates the Second Amendment, and remanded the case back to the district court to determine whether the government can prove non-intoxicated marijuana users “pose a risk.”
- The Superior Court for the State of Delaware has ruled that disarming young adults is unconstitutional under the Delaware Constitution.
- A Florida state court of appeals has declared unconstitutional a state law banning the open carrying of firearms, calling the law incompatible with the Second Amendment right to bear arms.
- Army Veteran Charged With Felony Gun Possession Despite Valid Concealed Carry License.
- The National Association for Gun Rights has issued a subpoena to Magpul, demanding the release of civilian sales data on standard-capacity magazines after the company refused to cooperate voluntarily for over a year. The data is for use in a lawsuit challenging Massachusetts’ so-called “assault weapons” and magazine ban in federal court. While the lawsuit is laudable, we don’t attack our allies.

- The Trump Department of Justice reportedly has been considering whether individuals suffering from gender dysphoria should be considered “mentally unfit” to own firearms. This would presumably require a statute change by Congress. While they are unquestionably – and by definition – mentally ill (and we all have our quirks), I see no across-the-board evidence that they are unreasonably dangerous to other innocent folks. I saw one report – based on data from the antigunners – indicating that the occurrence rate of transgender mass shooters is around 0.1%, and that trans people make up less than 2% of the general population. Meanwhile, many on the right want to ban guns for trans people who didn’t do it, while many on the left want to ban guns for everyone else who didn’t do it. And of course there is the total lack of due process.

- An Illinois father has been charged with a felony count of reckless discharge of a firearm after attempting to shoot a buzzard that flew into a building – only for the bullet to go through the bird and out a window before it fatally hit his teenage daughter. Apparently he was not charged for shooting the buzzard.

- An unknown number of “armed civilians” is being credited with helping neutralize two terrorists who opened fire at a Jerusalem bus stop Monday morning.
