Trumped

  • The US Department of Justice formally submitted to the Office of the Federal Register a proposed rule to again exercise of the Attorney General’s authority under 18 U.S.C. 925(c) to grant relief to individuals who are otherwise precluded from possessing firearms.

Litigation

  • The Firearms Policy Coalition (FPC) and the federal government have agreed to a joint dismissal of the government’s appeal of the Mock v. Bondi lawsuit, a case that successfully challenged the Biden ATF’s “pistol brace” ban rule and secured injunctive relief for gun owners while the case was being litigated to final judgment, which completely vacated the rule.
  • The American Suppressor Association (ASA), National Rifle Association (NRA), Safari Club International (SCI), Second Amendment Foundation (SAF), Association of New Jersey Rifle & Pistol Clubs (ANJRPC), and the New Jersey Firearms Owners Syndicate (NJFOS), as well as Silencer Shop, announced the filing of a joint federal lawsuit in the District of New Jersey challenging the state of New Jersey’s unconstitutional ban on firearm suppressors. This litigation joins Anderson v. Raoul, the ASA Foundation and Silencer Shop backed lawsuit challenging the constitutionality of the ban on suppressors in Illinois.
  • The FPC has filed a new Second Amendment lawsuit, Firearms Policy Coalition, et al. v. New Jersey Attorney General Matthew Platkin, et al., challenging New Jersey’s total prohibition on “short-barreled rifles” (SBRs), defined in state law as those with a barrel shorter than 16 inches or an overall length under 26 inches.
  • A three-judge panel of the Second US Circuit Court of Appeals ordered the dismissal of the NRA’s lawsuit accusing a New York state official of violating its free speech rights by coercing banks and insurers to avoid doing business with it. The Court said Maria Vullo, a former superintendent of New York’s Department of Financial Services, was immune from the NRA’s claims under the First Amendment because the law addressing her illegal conduct was not “clearly established” at the time that she pressured banks and insurers her office regulated into disassociating from the NRA. Despite NRA v. Vullo being remanded back to the 2nd Circuit by the Supreme Court in a 9-0 decision for rehearing, the Court of Appeals found that Maria Vullo and former New York Governor Andrew Cuomo (D-NY) were covered by qualified immunity. The appeals court returned the case to a federal district judge in Binghamton, New York, to formally dismiss all claims against Vullo. The NRA reportedly can still appeal to SCOTUS. The case is National Rifle Association of America v Vullo, 2nd U.S. Circuit Court of Appeals, No. 21-0636.

About those background checks.

UK bans lead.

  • In England, Scotland, and Wales, lead hunting ammunition is to be banned after a three-year phase-out period, starting in 2026. There is an exemption for the outdoor shooting of permitted birds and animals using small-caliber bullets, because of a lack of suitable non-lead alternatives. Also exempt are airguns, and ammunition used by elite athletes, the military, police and in outdoor target shooting ranges with risk management measures. Since the UK has already pretty much banned the use of firearms for self defense, the bullet ban will have no effect there and victims will continue to die.

Sig Sour Saga.

  • The US Air Force’s Global Strike Command has ordered an indefinite “pause” in the use of its Sig P320-based M18 pistols following a recent fatal incident at F.E. Warren Air Force Base in Wyoming. The USAF will issue M4 rifles in the interim. Reports indicate a desk sergeant assigned to the 90th Security Forces Squadron died after he unclipped his Safariland holster from his belt and placed the holstered pistol on a table, where it discharged, firing a round into his chest. The incident took place in a secure nuclear weapons facility inside Warren AFB. All branches of the US military use the Sig M17/M18 platform. There have been other incidents involving possible uncommanded discharges of US military M17/M18 pistols, including ones in Air Force service, in the past.
  • Gunsite Academy, one of the most recognizable and most respected names in the firearms training business, announced on social media that use of the Sig Sauer P320 will no longer be permitted in classes. Gunsite will allow Military or Law Enforcement students to use their P320 government-issued duty pistol, but will try to discourage those students from using it.
