Litigation

- Second Amendment Foundation goes after state of Washington for free speech violations.
- The US Department of Justice filed a new motion in United States v. Peterson revising their stance on suppressors, now saying that suppressors are covered under the Second Amendment, but are still subject to the unconstitutional National Firearms Act tax scheme. Well, I don’t see how you can have it both ways. You can’t have a special tax on a civil right beyond the same tax on anything else. You know, like a poll tax or a special tax on Bibles.
- The US Tenth Circuit Court of Appeals has found the law stripping gun rights from those with a different kind of domestic violence restraining order than the one already considered by the Supreme Court is still lawful. The case is US v. Gordon.
- The Georgia Supreme Court has unanimously upheld a state law prohibiting adults under 21 from possessing or carrying handguns in public saying the law does not violate Article I, Section I, Paragraph VIII of the Georgia Constitution, which guarantees the right to bear arms but specifies the General Assembly can regulate how those firearms are carried.

- A Short History of Unconstitutional Bans on Possession of Firearms in Federal Facilities. For at least 175 years, the United States did not attempt to ban the possession and carry of weapons in government buildings. Except for courthouses and legislatures in session, or polling places on election day, the right to keep and bear arms was not infringed in government buildings.

The Only Ones

- FBI Agent Benjamin Spinale is facing four misdemeanor charges for brandishing a firearm in connection to a shooting death investigation in Stafford County, Virginia, in which Spinale – while off duty – fatally shot a 61-year-old man who was assisting sheriff’s deputies. Apparently the agent has a history of gun misuse.
- An unidentified New Jersey security guard’s gun “accidentally” discharged while he was “behind closed doors in a single-use, staff-only bathroom” at Midland Elementary School.
- Marquis Ponder, a Kansas City (MO) resident and Center School District security guard, has been charged with second-degree murder after a deadly shooting in Kansas City last week while he was off duty. Ponder is also charged in Jackson Court Circuit Court with unlawful use of a weapon and two counts of armed criminal action.
- The former Los Angeles Deputy Mayor of Public Safety, Brian Williams, pleaded guilty on Thursday to a felony count of threatening to bomb City Hall.
- Two off-duty Jackson, MS police officers were arrested for fighting with a Walmart employee.
- Not to be outdone, two female uniformed US Secret Service officers have been suspended after reportedly fighting with each other while on duty in front of former President Barack Obama’s Washington D.C. mansion.

- Florida Man Rams Car Into Crowd Before Armed Bystanders Shoot and Detain Him
- Two landowners were picking mushrooms about a mile north of Choteau, Montana last week when they were charged by an adult female grizzly bear. The men shot and killed the bear at close range, and were uninjured during the encounter. We note that the Montana Department of Fish, Wildlife & Parks does not mention firearms in its bear safety recommendations.

- RIP Phil Robertson, the “Duck Commander,” a fine Christian and shotgunner, died this week at the age of 79. I was a Phil fan back in the early 1980’s.
- Gun-banning disgraced former US Rep. Charles Rangel (D-NY), a founding member of the Congressional Black Caucus and architect of the passing of the new machine gun ban in 1986 and who fought against our civil rights in Congress for nearly five decades, died at the age of 94 this week. I watched his illicit antics during the vote live on CNN late that night in 1986 and will never forget it. No rest, no peace.
